User has full access permission for another users outlook mailbox. Can If that user has read the other users mail?

I've recently taken a position as IT manager for a medium sized law firm and when I got here lots of our legal assistants had access their lawyers email. My question is if a confidential email is sent to a lawyer would I be able to tell if that legal assistant has read it?
Using outlook 2007 and exchange 2003 on windows xp

They probably have that access so they can manipulate their boss’s calendars.

It would be difficult to tell. Even if they have read it they can mark it as unread. Best policy is to tell your associates that they have two email accounts, a personal/ private one for private matters and a business email which is only for business. If you make the business account an Org box, they can share it out to their assistants but keep their private accounts to themselves.

I typically frown on sharing emails. If a particular email is in need of being shared I'll set up an additional mailbox so that a group can see it.

But personal emails e.g. firstinitiallastname@mycompany dot com I always make sure there is only one individual with access. It's just to hard to have accountability with multiple people. As said above they can always manipulate it and mark it as unread.. They can say they did or did not email something out etc. You can give access to calendars, different inbox's etc without sharing ones personal email.

Not to mention being it's a law firm (we have our own in-house law firm here) depending on what it is you could be violating a ton of laws as far as client confidentiality, if it's anything to do with medical... HIPPA laws etc.

Question is why do they have full access permissions? This isn't required for sharing calendars/tasks etc.
