GPU not operating in PCIe x8 slot, works in x16

My graphics card doesn't work in the top slot (PCIe x16) on my motherboard. It works perfectly in the x8 slot, and I know graphics cards do not fully saturate the x16 slot but I'd like to have it in there nonetheless. The card previously worked perfectly on another motherboard's x16 slot, so I'm not sure why it isn't working on this motherboard. I've tried resetting BIOS settings, plugging it in/out again, uninstalling/reinstalling drivers and overclocking software. (MSI Afterburner) The card works perfectly, I run graphics intensive games/test my overclocks with kombustor. It's only really personal preference/space/possible single digit FPS boosts that I'm looking to get out of this.

Specs:

Motherboard: GA-Z77x-D3h
GPU: XFX HD Radeon 6850 Black Edition
CPU: i5 2500k
Other specs can be provided if you need them. Motherboard is relatively new, couple months old. No problems with it and it hasn't been manhandled.

did you try the pci-e 16x with another graphic card to see if it will work .

No, I gave my brother a Sapphire Radeon HD 5570 that I'll test on the slot as soon as. Think it might be the motherboard?

yes it could the motherboard slot that why i ask you to test another card in .

Seems to be the motherboard. I tested it in x16 slot, no response, x8 slot, works fine. How would I go about getting a refund or maintenance?

this board is still under warranty ask for rma .
