If a cpu is labeled as ES, and for sale on a place like ebay, it's an "engineering sample" Not something meant for public consumption. It could potentially have bugs/errata and likely wont have microcode updates available via OS or BIOS. However, it also could have an unlocked multiplier allowing you to overclock the CPU easier w/o worrying about the FSB speed effecting northbridge or memory speeds.
