Specs:
i5 3570k
gigabyte z77x d3h (f16 uefi - latest stable)
8gb corsair vengeance (1 stick, XMP enabled)
hyper 212 evo

So ive tried for days now to bump up my 3570k to 4.4ghz which i hear is the 'sweet spot' for many with this chip. Got to 4 ghz with vcore @ 1.18v which already seems high compared to other oc-ers on this forum but still reasonable. To get to 4.2ghz i need to give about 1.28v and 4.3 @ 1.35 which as far as i know is crazy high, along with giving me temps touching 100C on prime(@4.3ghz) which is definitely not acceptable. 4.4 @ same vcore fails to boot.

At this point im thinking the chip i bought is just not that good and as far as oc-ing goes, way below average. Though i am willing to admit this is my first time ocing and i might be doing something monumentally wrong. If my chip is indeed bad, i can still get it replaced as im still covered by the 30 day replacement warranty (though it will be an effort), hence this post.

Either way, i definitely need help resolving this.

Solution
65C at 1.120v that is .. you need big big cooler maybe Noctua NHD-14 /phantec or water cooler also check your temp in bios if high from standard .. you need update bios ... good luck and keep cool

nah, its a straight up replacement. i dont need to state a reason. Dealer did mention i have 30 days to do so through him, else go to intel.
I do agree with what you say about overclocking, but i want to make sure i get the most for my money, specially if i still can. though of course i might end up with something worse.
what i really need to know is , if my chip is below the standards you might have seen around here. i have read about 4.8 @ 1.3v so, it seems to me that it is.

I know cooling is an issue, though mostly because the ambient temperature here is 35C at best. I am working on that though.
Also, my mistake, i get 100c on IBT not prime.

umm, its a 30 day product replacement. like i said, i dont have to to give reasons. i could get a refund if i wanted to. Have already consulted the dealer about this. thats not the issue here, i just need to know if you guys would rate it as an average chip or even below that. Im ok with an average chip, but owning anything less than that will keep me up at night.

another point is that default vcore values on my motherboard seem to be 1.25v when set to auto (fluctuates b/w 1.24-1.27 every time i load defaults in bios - even at stock speeds). Like i said, first oc so dont know if thats normal.
if i leave it on auto @4ghz , it will jump to 1.4v on load.

so the chip running at 4.2 ghz@ 1.35v is not far from normal? will i be able to go higher in the future ? i can only guess right now, but i think ill be at 1.4-1.5v at 4.5-4.6 ghz which is where i want to ultimately get to. will that be ok as a 24*7 oc provided i get a much better cooling system?
