So long as you use a legitimate key when you install it on the new machine you are good.

Not sure I understand your question there. If you have a legitimate copy of windows you can legally create a bootable usb and install the os from that. Microsoft even offers the iso image for download, so you can burn your own copy. Only "re-using" the key is illegal.
