new installation of i7-3770K problems

I dont know if I should be putting this as a problem with the motherboiard or the cpu, but Im going to start here.

I recently purchased a Maximus V Formula motherboard, along with an i7-3770k. I was running an old Q6700 prior to this, on a nvidia ultra sli mobo. My video card is a 680gtx, along with 8gb of DDR3.

So, after getting all the hardware replaces in my case, I boot up my pc and I get incredible lag, to the point where my windows would only boot up once out of 5 tries, and when it did, it would be ridiculously slow with mouse lag, and my cpu usage would be around 50% minimum on idle. Naturally I figured maybe its all my drivers being confused with my previous mobo, so I re installed a clean version of windows. Now that its installed, I am still having the same problem, but less extreme... My computer seems to run fine with cpu usage being from1%-5% on idle, and when I run a program like heaven benchmark, I get about 1-5fps and my cpu usage jumps back up to ridiculous numbers. Once I close Heaven Benchmark, the cpu usage stays between 25-50% on idle.

I'm finding this whole situation really frustrating and im hoping someone can help me. Ive built many computers and have never run into this problem.

Im finding on some sites that the problem is the compatibility with the 680 gtx. Ive never updated my bios before, and im kind of lost as to how to do it. I have both the .cap file from the asus site, and a blank usb key, but nothing I do seems to get it installed. No PDF came with the .cap file so im not quite sure what to do with it ._. I also heard that you need to rename the file to something different than what you get in the .rar from the asus site. How can I know what to name mine? Its called MAXIMUS-V-FORMULA-ASUS-1707.CAP.

OK LAST UPDATE, I managed to get the most recent bios installed, but Im still getting absolutely horrible performance in heaven benchmark with about 10fps, and my video driver crashes regularly. My processor still has random spikes and becomes slow after closing heaven benchmark. There seems to be a pretty big problem and Im hoping its not a lost cause :(
