Question about the legalities of selling a Win98 comp on ebay?

I was selling a Win98 comp on there and ebay removed it, the reason given was "copyright violation; unauthorized item". Now, I know it is illegal for me to install a different copy of 98 than what came with it and then sell it, but this was already installed when I got the comp.

I called ebay, and the woman I talked to was completely clueless....I could actually hear her flipping through pages as she went "uhhhh....uhhhh...."....finally she told me that my auction was pulled because it had "installed media" on it. Now wait a minute here; every comp on ebay that has an o/s on it has installed media, and I pointed out to her that not all of them could be illegal....she simply kept repeating the installed media line...it was obvious she had no real answer.

Ok guys, what is the real deal when it comes to selling a Win98 machine on ebay? Does there have to have a COA on the case? Does it have to come with an install disk? I thought that as long as it came with the original o/s it was okay, but maybe not. Thanks for any help you can give.

I cant see there being any problem, if the PC is pre-installed with Windows 98/XP/Vista etc then they have no right to close the listing. If you had listed a "back up" windows CD or similar I could understand it.

Thanks ulysses, I thought the same thing. What is frustrating is that it appears that not even ebay knows it's own rules, and so I can't appeal it. I just want to make sure I"m ok if I list another one, so that I don't get my ebay account suspended.

I'm interested in more opinions, guys....what do you think?

I'm surprised there aren't more answers here...I figured there would be some ebay veterans that have been through the same thing, and know ebay policy. I don't want to list something that gets flagged again and lose my ebay account....
