I've found that the easiest way for me to install / reinstall D3 is just to download it through my battle.net account. Usually less patching once installed and it wont hound you to register during the install.
If you prefer to use the DVD anyways, maybe try opening the disk and right click on the install file and "Run as Administrator" sometimes that helps. Also, make sure any anti-virus your running isn't interfering.

If you close the official downloader, when you restart it, it should pickup where it left off, provided you don't delete the temporary folder it downloads to. You can also save the file from Battle.net and run it when you have time to fully download it.
As for a torrent, I've never looked for one and not sure how trustworthy one would be.

The DVD is mainly so when you buy a physical copy, there is more than just a registration code in the box. Also, its useful if those don't have a good internet connection or a limited use one, then its probably best to install from the DVD.
