You can also add a Cooler Master Hyper 212 EVO for a little bit more so you can overclock if you don't mind going over budget a bit.

TBC1's build is pretty solid. If you need to shave off it, consider getting the FX-8320 instead. You can always overclock it to the 8350's level, since you have a nice CPU cooler.

1. Win 8 is fine for gaming
2. Wait on the SSD (spend more on needed components, cpu, gpu, etc). They will also drop in the price the longer you wait.
3. Allot of things require installing with a disk (OS is one), plus, optical drives are cheap - why not get one?

The 8350 is cheaper and OC's past the performance of a 4670k.

I'm using TBC's build but modifying it so is a I5 better than a 8350 or not? also im gonna have no optical drive, change the gpu so I can incorporate a monitor into my build and I'm going to change the OS to win 7

The i5-4670k beats the 8350 at stock speeds, however, for your uses the 8350 is more than adequate. The 8350 also leaves room for you to add better components as it's cheaper than the i5-4670k.

Note - don't sacrifice components to save money (i5 and lower end gpu, etc). Later on when things start to become more demanding you'll be like why didn't I get the 8350+280x (trust me on this).

Well to be honest, I think buying an optical drive will save you a whole lot of trouble (OS installation, convenient driver CD's, game specials in retail stores etc). It's worth the relatively small price imo.
