Shouldn't my new laptop run Need for Speed Carbon a game that is several years old?

I have an HP laptop with dual core i7, 8 gigs of ram, and a GeForce 740M graphics card. Sometimes I can run the game for over an hour with no problems on max settings but other times I experience very low framerates as low as 2-10 frames per second for a good part of the race. I have had framerate problems even when I lower the graphic settings. I contacted HP customer service as my laptop is in warranty and they had me reinstall the graphics driver twice. The first time it seemed to make a difference but then yesterday I had terrible framerates. Also I should note that I have speed-fan installed and the hottest temp was in the 40s Celcius when running NFSC. This microsoft page shows that NFSC is compatible with windows 8 which I have but HP support said that the game was not MADE FOR windows 8 and that could be why I'm having problems.

Another issue is that sometimes when I'm playing music on youtube with no other apps running the music will like freeze on a tone for 5 or so seconds and just repeat that tone. Also sometimes my cursor freezes for about five seconds like when I'm on facebook. My friend told me this could be a problem with google chrome but would that make my cursor freeze? I could see maybe the browser not loading facebook quickly but shouldn't I have control of the cursor?

Any help or ideas would be appreciated. If I have a defective laptop I want to know while it's still in warranty and get it replaced.
