GTX 760: TDR's and BSOD

TDR's on Windows 8 x64. nvlddmkm.sys BSOD on Windows 7 SP1 x64. System runs fine until I install ANY NVIDIA Drivers. Then I get TDR's. Safemode works fine with no problems in windows 7, I couldn't even find wordpad on Windows 8...
GPU: TDR's when using firefox, GeForce Experience, Battlefield 4, Rome II Total War, netlfix, and youtube. On Windows 7 I would get a BSOD with an nvlddmkm.sys error int he event viewer.I switched out the GTX 760 with a GTS 250 and I still got TDR's. I tried both cards to a different PCI Express slot. I have tried almost all the NVDIA drivers avaible for the GTX 760, all crash. BSOD in Win 7 on OCCT GPU Stress Test. I got the TDR's and the nvlddmkm.sys error on clean installs of Windows 7 and Windows 8 (first thing installed was Graphics Drivers).
RAM: Passed memtest 86+, Timings and Voltage set to 9-9-9-24-2N 1.5V in the BIOS, I tried the RAM int he other Dual Channel Slots.
CPU:i5 2470 settings in BIOS are on AUTO (Don't know anything about the settings there). Passed OCCT CPU and Link tests
SSD: Done Clean install of Windows 7 SP1 x64 twice and Windows 8 x64 once.
All temps stay under 50 C.
I downloaded the latest Direct X on Windows 7, no difference. Overall Windows 8 seems to be more stable...as long as I just use wordpad...

Anti-Virus: Avira Free Antivirus

Conclusion thus far:
GPU: GTX 760 should be fine due to the errors happening with the GTS 250 as well.
CPU: Passed OCCT tests, but not sure if I need to specify certain voltages or disable stuff int he BIOS.
RAM: Passed Memtest 86+
Motherboard: Not sure, tested both PCi Express and all 4 RAM slots.
SSD: It is awesome.
Drivers?

Sound: Realtek latest drivers from ASRock, disable NVIDIA High Def and Virtual Audio?
Chipset: latest Drivers from ASRock
LAN: Realtek latest drivers from ASRock
GPU: Latest Drivers from NVIDIA, on board VGA is disabled in Device Manager
BIOS: latest 1.7 for the EUFI.

Incompatible Hardware? (CPU and RAM on mobo supported list). Does this board hate NVIDIA products? (it seems to be made for ATI crossfire). Bad component? Conflicting Drivers? Fate?

let me know what yall think, I'm going to go to work and pretend this isn't happening.

Your motherboard could have a defective or corrupted bios file, also the bios chip itself can be defective. I didn't think of it earlier because it was acting different from the situation that I had encountered with a Gigabyte board. I had a three way SLI set up that started acting in a similar way with game crashing but when one card was removed everything was fine until the card was put back. Then it started with the next card and soon I was down to one card working until that one started crashing and after en extensive trouble shooting period the board went back to the manufacturer and it was determined that the bios chip itself was defective. It was replaced and everything worked fine. Reloading the bios file did nothing for my...

On board VGA works like a charm. No issues thus far.

What about the GTS 250? It worked fine in my other computer but did the same thing in this build? I know its a good card. MSI has a RMA set up with me, I just wanted to double check before I sent it off.

Pulled the GTX 760 out. then pulled the battery for 20 seconds. But it back it, threw in the GTS 250 and started it up. No problems. Put the GTX 760 back in, TDR. So, i did it again and have the GTS 250 working great. Have an RMA set up with MSI. I'm going to read up on bios and try to learn a bit more about them. I really appreciate your help. Thank you
 
After you do your reading up on the bios you could try to do an update of your current bios and not necessarily go for the most recent but to just change what you have to see if that helps with the 760, at least you'll see if that does anything. The thing with RMAs is that they are good for a period of time and even if you let it expire you can always redo it.
