Buying Windows 7 Or 8 Used? Is It Safe, What To Be Wary Of?

I just need an OS for my build (seen here: http://pcpartpicker.com/p/29QTL), and I'm wondering about the cheapest way to get either Windows 7 or 8. Looking at used products online, it seems I could save as much as $40-50, but I'm wondering if there's any potential pitfalls. I'm also wondering whether 7 or 8 is better (I plan to play a decent number of older games such as Morrowind, System Shock, etc). I've heard of compatibility concerns, but can anyone enlighten me on what they are?

I also have a retail copy of XP, which is supposedly eligible for upgrade, but I would like some advice on that as well.

Don't buy a 'used' OS. The OS is just as much a part of the PC as the motherboard, RAM, PSU, whatever.

Would you buy a potentially counterfeit motherboard? Possible illegal RAM sticks? No.

Ok, then what is my cheapest option for a new OS? Like I mentioned, I have a retail XP copy, so I've heard I should be able to use an upgrade copy. Is that correct? Also, I plan on getting a family pc, and may want Windows on that. Is it possible to get a single copy of Windows for my entire home, or is it per machine? And is Windows 7 or 8 better for gaming?

Sorry for the barrage of questions, but this is the last part of my build I need, and I'd like to get it together as soon as possible.
