Windows 8 to 8.1-HDD to SSD data transfer, strange request

Ok, so I'm not sure whether this post belongs in the Memory forum or the Windows 8 Forum, but I have a kind of weird question. I have an HDD with Windows 8 Installed already, it is my C drive and currently my boot drive. I have volumed and partitioned my SSD and it is ready for data, but it has nothing on it. I have not downloaded Windows 8.1 yet, but I was wondering If instead of downloading it to my C Drive and replacing the current copy of windows if I could download it to my fresh SSD (Samsung 840 120Gb...black Friday deal), go into my BIOS, set my primary boot drive to the SSD, boot up 8.1, go through setup and all, and then transfer all the files that I want from my HDD to the SSD.

Is this even possible? Will the copy of Windows 8 conflict with 8.1? If it is possible, could you please, in detail, help me with the steps on how to do this.

I'm guessing I'd have to set the SSD to the place where Windows 8.1 downloads. But, I'm downloading it from the store. Is there any way to change it or might I be able to change my SSD to the default C Drive and ONLY download Window 8.1 to it. From there could I just go on with my plan? Are there any alternate ways to download Windows 8.1 (legitimatly) so that I could choose where I download it?

If anyone has experience with this or any actual input, it would be much appreciated.

2 options:

1. Install Win8 fresh on the new SSD. Then upgrade to 8.1

2. Reduce the size currently used on your HDD down to around 90GB. Use one of the many migration tools to migrate the existing Win8 over to the SDD. Then upgrade to 8.1

Personally, I always recommend a clean instal on the new SSD. Far fewer potential problems.
