AMD FX8320 - Can't get the heatsink latch to lock in

CPU: AMD FX8320
MB: Asus M5A97 LE R2.0

I've had issues getting heatsinks on before but this one is by far the worst yet.

CPU is locked in to the motherboard, no issues there.
Heatsink resting on top of the CPU, the copper sides look to be resting on plastic on all 4 corners.
I can get both sides of the metal hinge thing on.

Trying to turn the latch 180degrees and I can only get about 110.
I've tried wiggling the metal hinge back and forth as I've done this and even went so far as to
use a screwdriver for leverage.

I've actually started to bend the plastic latch.. what is going on here??? can't they come up with a better design?

Does anyone have any pointers?

I could switch to another heatsink but what if this CPU is DOA.. warranty claims that it won't be covered if not stock heatsink...

Just keep messing around with it, it can take a while. There is also no reason to use an aftermarket cooler, you can get one better than the one it comes with for $15, and a large improvement for $40. The warranty is different than if you get a DOA chip, too.

I am just starting building my PC, same cpu, same issue. I feel like I am going to break the thing. I literally am stuck at 110 degrees as well. There has to be a solution.

I've pretty much given up.. my thumb is raw from too many attempts
I've gone so far as to partially unscrew the screws holding the posts on the motherboard... then putting the hinge in the lock position to start and trying to connect both latches.

Going to take it in to a local computer store to try (apparently it's $15). I've already spent 2+hours and my time is worth more money than that.

Shame on AMD for this nonsense design.

took it in to a computer shop and they couldn't install it either.. they tried to say that because the plastic on the latch was bent, it was causing the issue...
Had to go with a cheap aftermarket... going to be contacting AMD to see if I can get compensation for this garbage..

I just got through with this exact problem with the FX 8320 and it was extremely frustrating. I honestly don't think they can expect you to put as much force on the mobo as it would require to get both latches on normally. I had to loosen three of the four heat sink support screws (the piece that comes mounted onto the motherboard that the heat sink's brass tubes rest on, or at least they do on mine, the ASUS M5A97) to the point of almost coming out, and only then could I manage to get both latches on and flip the lever. (which I did very gradually and with steady force)
