I was testing for a bottleneck because my brother has the same graphics card and gets almost double the frame rate with opengl.
i have tested my gpu in his computer and the other way around with the same result.
So i think i might have a bottleneck. This is my specs i dont know all of his.

CPU: AMD Phenom II x6 1075t 3.0Ghz
GPU: EVGA Geforce GTX 760 SC edition
RAM: generic 8GB DDR3 1333Mhz 2GBX4
PSU: Corsair CX600
Mobo: MSI 970A-G46

CPU Clock:53% Mhz, GPU Clock: 1215 Mhz
CPU Max used:1600 Mhz, GPU Max used: 51%
Cinibench opengl benchmark: 40.1 fps
Cinibench CPU benchmark: 241 cb

CPU Clock:100% Mhz, GPU Clock: 1215 Mhz
CPU Max load:100% GPU Max load: ~50%
Cinibench opengl benchmark: 60.31 fps
Cinibench CPU benchmark: 448 cb

His specs to the best of my knowledge.
CPU: Intel I5 4670k
GPU: EVGA Geforce GTX 760 SC edition
RAM: Brand unknown 8GB DDR3 1600Mhz 4GBx2
PSU: Brand unknown 600W
Mobo:MSI B85 G41

Mainly want a second opinion before i buy a new cpu. Thanks In advance

Oh in that case it probably is CPU bottleneck then. Those games are probably just a lot more CPU intensive. Try a mild overclock if you don't have the cash for an upgrade just yet.

Thanks For the quick responses. Could a FX 8350 be enough to get rid of it? From what I've seen it is not as powerful as a 4670k but it is more powerful than a phenom 1075t and the best one i can get with this motherboard.

He gets about 30% better performance in some games but others its about the same.

Okay thank you. I will probably get the fx 8350 and hope it gets rid of it. Also i had to replace the motherboard recently because of a bad pci slot but it was doing it before that. Thats one of the reasons i assumed it was the cpu.
