First time build running slowly and inconsistently, unsure of the problems

I just bought and built a new system (2 days ago) and it is generally running very slowly in windows 7. All programs, including explorer.exe load slowly, internet pages generally load slowly, and installing anything including drivers takes a very long time, and occasionally will freeze the entire cpu to the point I have to shut down and start over. However video, including live streaming video, and online games runs cleanly and clearly once connected to a website.
Bios seems to run fine. Ive tried downloading all the latest drivers from their respective websites, and have run cpuz and several hard drive diagnostics. From the data Ive received I suspect that there is a hdd issue. However, I am unsure if this alone is causing my problems, and would hate to fully reinstall everything under the assumption its the hard drives fault when perhaps another new part is failing. Its also possible that windows and not hardware is the problem, but I am unsure how to check that.

Chckdsk has come up clean multiple times, as has hd tune, but every speed test run shows incredibly slow speeds and scores.
Im really not sure what to look for, but I know my rig should be much faster. The 3 year old laptop I am on right now runs much more smoothly and quickly. Any help steering me the right direction would be appreciated.

My new system includes:

ASUS m5a97 le r2.0 mobo
fx8320
2x 4gb gskill ripjaws 1600
Western Digital green 1 tb hdd with 64 mb cache (rebuilt/certified by manufacturer)
Sapphire Radeon HD 7870 OC edition
650 watt psu (antec ea-650 green)

CPU-z results:
1516.94 mhz speed x7 multiplier ~216 bus (it changes)
dram freq 722.4
graphics core 1050 mhz, 1250 memory

The reason I suspect its a hard drive problem- hdtune transfer rate on benchmark diagnostics got down to .1mb/s (maxed at 90.5) and dskspeed showed extremely slow access time and cached speeds (varying over several runs, but each leading to an overall score in the 2 digits, when an average score should be 5 or 6 digits)
however chckdsk gui shows the drive as notdirty.

Anyway, thats about all the information I can think to give, would be happy to supply any other info that can help.

Well, if you don't have another drive to test with, how about running the system off an Ubuntu live CD, possibly even without the HDD attached.

You can download the Ubuntu .iso file from ubuntu.com and burn the disk, which gives you the option to boot the Ubuntu desktop from the DVD without touching the HDD. If there's anything else causing slowness you should see it browsing through the Ubuntu, but if it's quick when not running off that HDD, that's another piece of evidence.

I now see the more thorough diagnostic. I am currently running a long one on HD Tune and will start the long ones for both lifeguard and seatools. I'll update when they go through I suppose, but that will literally be hours from now.

I left the computer on for hours running western digital and hdtune, and then I got a message saying the harddrive was at a critical temperature (122 degrees c) so I shut it down. Seagate wouldnt load, and would freeze the system when attempting to load.
Its now running just as slowly as before, but dont want to run those programs again and risk burning it. Anything else I can do to ensure its just the hard drive? From that temperature Im pretty sure its safe to conclude it is at least the hard drive, but Id rather solve everything in one exchange rather than keep coming back.

Also, Im not sure how to "prove" this when asking for a replacement part.
