OC'ing i7 3770k to 4.0GHz on Stock Cooler Question

Is it safe to do this? I was disappointed to find out that my cooler master hyper 212 EVO just isn't working and I just don't have the money nor the patience to replace it, however, with the stock cooler is it actually possible to OC to 4.0GHz safely on my i7-3770k? Motherboard is a GIGABYTE GA-Z77-D3H if it helps.

I suggest to dont do oc with stock cooler , do it on your own risk . Stay stock until you get a new heatsink

It isn't me that's constructing it, I sent it into a PC store and this is what I was told. I bought the k series because I wanted to OC to 4.4GHz with my new cooler, but I was only asking if OC'ing to 4.0GHz is safe on a stock cooler... don't blame me, I'm not there, I don't know fully what's going on. I'm not sure how he's installing the cooler.
 
i'm not blaming you, but it makes no sense whatsoever.

for the question, you don't know until you try - some cpu-s will work while others won't. you can overclock it, and prime95 to check if it works. if it overheats then the answer is no, if it doesn't you're good to go.

all i'm saying is that the cm 212 should work, there's no reason it wouldn't fit. can you tell us also the case model?

I have no idea what the case model is, since I've owned it since 2008 so I am sorry. However, I found a picture of it.

I google'd "Computer case blue bubble led" to find it. I'm unsure of its exact model.

EDIT: Apparently it is the 1782 Galaxy midi case with blue bubble light

So I spoke to the man and I was told that the cooler master hyper 212 evo is so big, that it actually comes very close to the side of my case, he is worried about it damaging my machine. He says he will install it if I request it, but he said either it will touch the side of my case or be perilously close to touching it. I really don't know what to do at this point. I asked about other coolers and he told me we could both pick out a heatsink together. (But I actually need my system done by tomorrow, since I can't keep borrowing someone else's laptop just to work XD).

So... do I... use the CM Hyper 212 EVO, or use the stock heatsink and get a different cooler in the future? What is the safest approach? He just really doesn't want my expensive system getting damaged. I am not sure if the cooler is like, too heavy...I DON'T KNOW! ;_; Pls halp! Is it safe if it's extremely close to the side of the case?
 
you mean it nearly touches the side panel? that's perfectly normal. the tower coolers are designed to come close to it. unlike standard coolers the air the air they push goes towards the back and not towards the side panel. it's a problem if the cooler is pushed down against the motherboard by the side panel, yes. but if you have a few mm of clearance it's fine
