ASUS 7790 II OC Barely works, Faulty or PEBKAC?

Here is the situation.
New build, new everything, built in the last week, parts arrived in the last 2.

MB: ASUS M5A97
RAM: 2x4GB Corsair Vengeance (1866)
CPU: AMD FX 8350 (8x4.00GHz)
GPU: ASUS 7790 2GB DirectCU II OC
PSU: 750W Corsair 80+Gold
OS: Win7 SP1 64-bit

I fear I may have a slightly defective card, or a rather annoying driver bug.
I have tried several times to update the drivers, update the AMD CCC, without the CCC, with just what came on the disk with the GPU, and I can not for the life of me seem to be able to get this thing to work completely right.

For the greatest portion the card works. Desktop runs, internet browses, games are good, mostly.
Driver crashes are frequent, screen freezes, goes black, comes back, says it has recovered, may or may not have crashed my game/chrome. Chrome hardware acceleration is off, and is not always open when crashes occur, but is affected by them. Additionally there are certain spaces that mistakenly render either white, black, or a color the program is using at the time in a different 'layer' of the game. (such as a piece of the HUD replacing the terrain)
I have been able to remove the discolored portions and greatly reduce the frequencies of crashes, but to do it I have had to underclock the card speed to BELOW STOCK levels and I frankly can not stand doing that.
I do not think it is a temperature issue as I have never seen it go above 80.
I do not think it is a power issue, peak voltages should only push me up to about 670W.
I have tried both PCI Express ports I have, I have tried reseating it, I have confirmed the fans both turn.
I have no on-board graphics to cause interference or fall back on.
I can not find any errors in any other part of my system, just graphic driver crashes.

As I type this the errors persist under any noticeable GPU load.

Current Driver: AMD Radeon HD 7700 Series 13.251.0.0 (12/6/2013)
Catalyst Control Center Version: 2013.1206.1603.28764
2D Driver version: 8.01.01.1360
Direct3D Version: 9.14.10.01001

Am I missing something or is there a real chance I have a defective card?

EDIT: Worth noting, I am using only the HDMI port on the card.

Just for clearing it out, have you connected the correct power cables on the gpu?

I have connected the 6 pin power, yes. valid cable, no attempts at custom rigging.

I think you have to RMA the card. From the specified symptoms I reckon it has to do with hardware issues.

I feared as much but wanted a second opinion because I have never built a computer before so I will admit it is quite possible for me to botch something but I thought it might be because i do know some about software

EDIT: As of 1/14 it appears the card is rapidly degrading, it is now consistently operating well below even 700MHz even when put under load, causing significant stuttering, as well as failing completely if left to idle for too long forcing a restart to restore functionality. Removing and reboxing for shipping immediately.
