Hyper 212 EVO + LGA1155 - issue trying to mount (see pics inside)

I am trying to mount my Hyper 212 EVO on my i7-4770k (LGA 1155), and it doesn't seem to sit right. I think I mounted it properly, but the cooler seems to move a little bit despite being bolted tightly. I suspect I may have used a little too much thermal paste which may be causing it to slide.

The cooler also seems to be touching the bracket which holds the processor down to the motherboard (Gigabyte Z87X-UD3H). Is this supposed to be?

Solution
If the 212EVO is like the 212+, there is only a pair of loose-fitting pins on the bracket fitting into loose holes in the aluminum block to prevent it from slipping off the die or rotating a lot. Some wiggle-room is normal; no amount of tightening will prevent it.

I just assembled a machine with 4770K LGA 1150.
The 212 EVO was also slipping slightly, but the temps was just fine.
I would just turn it on, and watch the temps in bios as the first thing.
