Is my video card dying?

Hi, I had an asus gtx 670 that i killed when overclocking. Asus was kind enough to honour the warranty and sent me a refurbished model. I don't trust it (or myself) so i haven't overclocked it all. It's been about 3 months since i got it and everything has been fine up until now. I was playing League of Legends and it keeps switching to windows classic theme (I think windows is trying to maximize performance for some odd reaspm) and the video card is running at about 50%. I'm getting around 150 fps. I've tried it off with v-sync but whenever there is an increase in things happening on the screen the game does drop down to 30 frames for a split second until the gpu catches up. In BF4 i don't get 100% GPU usage it fluctuates between 95-99%, I never paid attention to this but i think it's normal.

edit: Side Notes
I have an i5-3570k @ 4.2 and the psu is a corsair hx850m.
There have been no graphically artifacts, ever.
And i have a custom fan curve and room temp is usually around 22 so the card rarely goes above 65.
 
Windows likes to switch to classic theme when I start a game too. It detects the GPU load and disables aero I guess
League of legions is a online multiplayer game no? if it is, what you could be seeing is net lag

GPU failure usually shows up as crashes, freezes and artifacts

No i'm on a single 2560x1440 monitor. I've been seeing net lag from my new router that I got. And i haven't done a windows experience update since i got my ssd a few months ago. Thanks for the suggestions.
