really sick performance

So I ended up giving my second rig to my girlfriend.
My main rig psu gone skyhigh so I don't have anything to power the unit.
Finally last week decided to get a new build and that's what I did.
Yet the problem is I tried this rig on like 8 games.
6 really old like: gothic 3, gothic 4, worms 4, oblivion, tdu, crysis
2 new: Assassin Creed 4, Crysis 3
Extremely weird no matter which setting or resolution I try the fps are always exactly the fricking same.
Crysis 3: min fps: 3 fps
average fps: 7 fps
max fps: 15 fps

Assassin Creed 4: min: 59 fps
average: 75 fps
max: 120 fps

gothic 4: min: 90 fps
average: 120 fps
max: 180 fps

gothic 3: min: 4 fps
average: 10 fps
max: 15 fps

worms 4: 100fps locked O_O

oblivion: min: 50 fps
average 80 fps
max: 180fps

crysis: 999 fps locked (my ass it's not even playable just lag and stutter non stop)

tdu: 2fps locked; crash after 5 minutes of photos exchange like 10 seconds between each photo.

yes this is all ridiculous. it does not even make sense and it blows out my expertise level.
so please tell me what I gotta do cause I am left here clueless.
Should I RMA gpu back?
no silly questions please. all drivers are up to date, only 2x aa, no v-sync and no 3d or other eye candy.
no oc as well.

so here is the rig:
i5 4670k
msi z87-g45 gaming
8gb 1600mhz corsair vengeance
hr-02 macho cooler
gtx 770 2gb windforce 3x
cougar powerX v2 700w 80+ bronze
corsair 200r
seagate baracuda 500gb sata 3
windows 8.1 (is the windows the problem? never tried 8.1 so clueless here) updated all it asked.

I am not a gamer but I hate to have a deffect pc taking into account the price it costs.
sometimes I feel the performance in gaming is really crap
using a 1920x1080 60hz so shouldn't be the problem.
even tried 1366x760 and same thing
even 800x600 shows same fps and low or max settings makes no difference in gameplay and fps.
really weird.

well the old psu in the main rig died but the gpu used at that time was a gtx 780 wf 3x which was still 100% working and which I sold to get a 7850 cheaper one.
this rig is completely new.
I reinstalled again an tried furmark benchmark 1080p 0aa and got 2980 score.
is this good now? o_O

k guess that's it.
still I saw hd 7970 hit 3300 score O_O weird
well k thanks mate.
that one got over myself so I was worried the gpu was deffect.
btw I saw gpu stay at 90% all time? is that normal?

gaming wise I am still unhappy.
while crysis, tdu, worms, crysis 3 (35fps min) and creed have become really playable mostly at 60fps minimum
gothic 3 has unstable fps like 30-400, gothic 4 50-180 total unplayable lag and stutter.
oblivion is playable but for an old game with no mods getting 50-130fps is a bit funny.
and in all games fps is never stable. numbers keep changing like crazy ...
thing is games don't feel smooth at all.
if I were to play on low settings on my laptop with crap hd 6490m it feels lot smoother and playable than ultra on this with 60-150 fps...
