I want to replace my 250gb PS3 HDD which has no more free space. I have lots of digital games(thanks PS+), so now I need a larger capacity HDD. My concern is that if I want to sell it after I get my new one, should I format it or would I be able to get more money if I left the games on there. Are there any licensing issues and other nonsense which I know the Xbox has.

Digital games are tied to your account so if you wanted to sell the games for a profit you would need to hand over your account, as well.
