Aftermarket Heatsink not working?

So i bought a I7 4770K and a 212Evo by coolermaster. i am not overclocking but my cpu keeps shutting down, i'm maxing temps at 50C and i'm concerned. I have it so tight that the nuts under the board twist when i try to tighten the heat sink. But at the same time i don't feel like it is down all the way. I am still able to twist the heat sink just a little bit. Also my CPU keeps randomly shutting off every few hours with kernel 41 error. I don't know if the nuts underneath need to be tightened then the heat sink but maybe i'm just paranoid.

50C is fine, although it sounds like you're over tightening the screws, they should be snug.

Kernel 41 error can be several things ranging from PSU issues or conflicting drivers or other software issues.

I suggest jumping on google and seeing the different fixes people have for this issue.
