CPU fan on fx-8350 not working correctly(not responsive to temp or tied to wrong temp!?)(first time build review welcome)

Hi, I just made my first build two days ago so please forgive the lack of experience. On build the mobo would not post (would not even respond other than gigabyte logo) and I thought I'd have to RMA but a clr coms via battery removal reset it and got my beep. I explored the bios a little but the only setting i changed other than system time was cpu temp warning to 80C(tjmax for a fx-8350) before a clean windows 7 install. Installed steam and some games first thing to test this baby out(yes i should have done a stress test first, checked temps in bios and everything was gd at idle tho) and 10mins if that into AC:BF the nvidia card came with I got the 80C warning beep and checked temps to confirm, shut everything off and started looking into it, easy tune 6(came with the gigabyte board i don't plan on overclocking anything) listed cpu fan rpm at 700 even with the cpu temp at tjmax, this seemed low to me so i went into bios to explore fan options. it was set to AUTO (and yes the 4pin cpu fan was plugged into the cpu_fan header next to it) other options were MANUAL or DISABLED, manual let you select from .75 pwm-2.5pwm/C (can someone explain this? i thought ive read pwm was only for certain fans) I tried 2.5 pwm/C and tested and didnt see a change(i have limited knowledge on this sry if that woulda been obvious or ill advised) so put it back to auto. looked into easytune more and found the cpu fan plot points were set correctly(slop from 10-100% 20-60C) and fiddled around with them and noticed i could get it to kick up higher by raising the min temp(which has solved it for now) but the problem is from what i can tell it is using the "system temperature" instead of cpu temp to adjust cpu fan speed!(set plot points up and down kicked on above 35 off below it when cpu was at 70 and system temp in easy tune was 35, yes im sure the cpu fan is in cpu_fan header yes im sure that graph was for the cpu_fan) this could be a coincidence and it is just not triggering the fan with the cpu temp reading correctly but seems likely its tied to sytem temp... either way its not raising fan speed with the cpu temp and let the cpu get all the way to 80C tjmax for fx-8350 and fans were still at 10%!!

for now i have min cpu fan plot point in easy tune set to 60% which is right before it starts to get loud and seems to be doing okay, but id much rather get active cooling working correctly.

can someone more experienced give me a little guidance please? tyvm

any comments/criticism/concerns/recommendations for this setup is greatly appreciated also(i'm new at this, aware i should get aftermarket cooling for it prob, stock seems to keep it cool when working properly tho and as of now have no plans on overclocking)

p.s. easy tune came on the mobo drivers disc, fan speed settings changed in it persist when its closed i assume it doing this by changing profile settings or something for the bios that i don't have access to/see in its interface? not some process i am missing(don't see anything related to it after close) and therefor uninstalling easytune prob won't matter? can try it anyway since i have the disc but based on the reasoning i assume it won't(again anyone more knowledgeable feel free to enlighten me)

the cooler seems to work even under load when its 70-80%+ fan speed(im not overclocking), i fear the problem will persist even with a new cooler unless some1 can explain why it would change? cpu coolers do not come with a separate fan controller driver right? (ive never bought one...)

well the stock cooler is highly not reccomended it could be the stock cooler that is causing the problem
