is it legal to turrent the game if ur only getting the files so u can make use of ur cd that still works when the other 2 cds

i keep getting an crash error when trying to launch it with my windows 7 operating system and i was getting it erroring saying not installed propperly even when i had xp i think it got a critical scratch that won't install propperly anymore so i need files of preinstalled version that is just straight from a cd ect that some1 else has if anyone else playes that game anymore that is concidering how old it is and being discontinued for ages now the 2 sequals weren't as good as the 1st least to me the 3rd make of that name was most limiting of them all dungeonsiege 3 and diablo 3 are 2 example games that put too big of limitations based on my favorite play styles

You don't need cd to install diablo 3. Just use Battle.net app (download from battle.net website) and you can install from there. And use punctuation when typing.

Seems like a grey area to me, since you already bought a copy of the game, as it would be the same as if you had made a backup copy yourself of the disc. However, the files themselves are still copyrighted so it may technically be illegal. electrontau is right though, you can just download the game as you would World of Warcraft.
