Well you don't need to spend quite that much

This is the top-end of what I would spend:

PCPartPicker part list: http://uk.pcpartpicker.com/p/12fIn
Price breakdown by merchant: http://uk.pcpartpicker.com/p/12fIn/by_merchant/
Benchmarks: http://uk.pcpartpicker.com/p/12fIn/benchmarks/

CPU: Intel Core i7-4770K 3.5GHz Quad-Core Processor (£235.99 @ Amazon UK)
Motherboard: Asus Maximus VI Hero ATX LGA1150 Motherboard (£151.91 @ Aria PC)
Total: £387.90
(Prices include shipping, taxes, and discounts when available.)

Since you already have an h80i you should get a brilliant overclock out of it.

More realistically you don't need more than either of these...
depending on the game you will get a little better performance but that is more in the way of CPU bound games.

FYI AMD purchased ATI and has since droped teh ATI brand name. So this means the cards are now labeled "AMD Radeon HD 7970", no ATI. just some info for you.

That board would catch fire trying to use either of those chips. It doesn't support that high of a TDP. OP, with that board, best you can do is an FX 6300/6350. Either will be better than your 6200, but you really need an new board and CPU to get a worthy upgrade.

he can do an 8300 that will be worth the upgrade.

A decent upgrade, but they're somewhat scarce.

EDIT: Beat me to it.

Well, first off, I would say the motherboard needs a bios flash if you haven't done so already.

A quick google search suggests that the 8350 won't go too well in that motherboard. A lot of people say it throttles and even overheats. I would look into that before making a move.

Just to answer your question (pending your investigation into the above), yes, the 8350 is the best improvement, cpu wise, to help with your gaming. Anything from the FX 6300 up is an improvement over the 6200.

edit: oops, took too long to answer. There you go, 6300 or 6350 is the best upgrade for that motherboard cpu wise.

ok so im playing elder scrolls online on max settings with view distance set to 30%
built up areas 30-50fps
pvp battles 15-25fps
normal -35-95fps
have not modified anything on computer other then using catalyst control centre to overdrive the following~
Gpu clock settings 1000mhz
power limit 0%
High performance clock settings 1575mhz
Cpu 4500mhz
Gpu idle temp 42c
Gpu stress temp 72c
Cpu idle temp 20c
Cpu stress temp 42c

so what will improve these fps as been told changing cpu won't actuality make much difference there saying its my gpu that needs to be upgraded to improve fps and allow me to also max out settings??
Should I buy a duplicate of my 7970 and have 2 running??

A second 7970 won't make much of a difference in this situation. The Second PCI-E x16 slot runs at just x4 so a second 7970 would be completely wasted. I believe you're CPU bottlenecked.

If I were you, I'd make the jump over to an intel CPU and motherboard.

Do you have a budget for an upgrade?

Since you already have an h80i you should get a brilliant overclock out of it.

More realistically you don't need more than either of these options:

PCPartPicker part list: http://uk.pcpartpicker.com/p/12hnl
Price breakdown by merchant: http://uk.pcpartpicker.com/p/12hnl/by_merchant/
Benchmarks: http://uk.pcpartpicker.com/p/12hnl/benchmarks/

CPU: Intel Core i5-4670K 3.4GHz Quad-Core Processor (£160.79 @ Aria PC)
Motherboard: Asus Maximus VI Hero ATX LGA1150 Motherboard (£151.91 @ Aria PC)
Total: £312.70
(Prices include shipping, taxes, and discounts when available.)

Or this:

PCPartPicker part list: http://uk.pcpartpicker.com/p/1Webc
Price breakdown by merchant: http://uk.pcpartpicker.com/p/1Webc/by_merchant/
Benchmarks: http://uk.pcpartpicker.com/p/1Webc/benchmarks/

CPU: Intel Xeon E3-1230 V3 3.3GHz Quad-Core Processor (£176.39 @ Aria PC)
Motherboard: ASRock Z87 Pro3 ATX LGA1150 Motherboard (£67.00 @ Amazon UK)
Total: £243.39
(Prices include shipping, taxes, and discounts when available.)
(Generated by PCPartPicker 2014-05-09 23:26 BST+0100)

The Xeon 1230v3 is essentially an i7 4770 (can't be overclocked, no IGP, slightly lower clockspeed).

In your position, I'd go and get the 4770k. And yes, it would make a big difference, though an i5 4670k would perform almost identically in the majority of cases.
