Used hard drive still contains data.

Should I be concerned, I bought used hard drive on amazon that was appose to be opened but never used, just installed it and went to install windows and noticed 2 partitions. I canceled the install and booted puppy Linux to see if their was anything on the partitions and sure enough, the first partition was a dell recovery partition, and the second partition was the main windows/use partition. Apparently the drive was used and the sell never wiped the drive and left all the files intact including personal documents and pictures. I checked the drive and it appears to be in %100 working condition.
 
Well you could probably return it if you like if the selling description said it was unused. As for being concerned I wouldn't really be but it would be considerate of you to completely wipe all of the former owners personal files and everything off of it

I contacted just contacted the seller about the issue, waiting for a reply . It doesn't really bother me, if it's used, cause I only paid $23 for it and it's 500gigs. Would it be legal if erased everything except a couple of the iTunes songs.
