you are not supposed to format SSD's to wipe them. If you need to secure erase the drive you should check to see if kingston makes software for it.
read this article and follow the directions and see if you can secure erase it and resolve the issue. http://www.kingston.com/us/community/articledetail/articleid/10?Article-Title=SSD-Data-Wiping-Sanitize-or-Secure-Erase-SSDs
The drive would not reformat under windows and I did follow that guide after being advised by Kingston to use HDDErase. The drive will not reformat under windows or PartedMagic... I think it is cactus.. and well out of warranty.
So just to be absolutely clear. I tried to reformat this drive under windows but the existing partition with files intact would persist. No error message.
So after email exchange with Kingston tech support I secure erased it with HDDErase. Now under windows 7x64 when I try and initialize the drive I get an error about being unable to update the interface or something..when I try and format under PartedMagic the drive is missing a partition table .. When I try to create one - any format GPT, Mac, Dos it doesn't throw up an error but it doesn't create a partition table either...so I cannot create any new partitions.
