Ram Failure memtest

PSU 500W SST-ST150
RAM 2x4GB Crosair DDR3 Vengence LP PC3-12800 (1600), Non-ECC, CAS 9-9-9-24, XMP, 1.5V
OS Win 7 Ultimate 64bit
HD x2 2TB Seagate

I have more then 700 errors found during Memtest86 5.01, the CPU temp is 52'C. The Timings are running CAS 6-6-6-20.

Memtest reports 665 MHz (DDR3-1330) why does this differ from the manufacturers stats?

Also due to the number of failures and the ram being just over 12 months old can I definetly say the ram should be sent for RMA?

I have also been getting BSOD IRQL not less or equal too with the message ntoskrnl.exe

Let me know if there is any further information anyone requires and what is best solution is.

Question: How will this solve the problem considering that the problem has only occured as I have made the build just over 12 months ago and never had any problems till now.

The only thing I was doing prior the message appearing was moving my user files to another drive to reduce space from my main c: so that I can migrate the OS to a 128GB SSD.

The BSOD appears now almost everytime I try to do anything during the normal OS but during safe mode it takes a while for it to appear.

Just looking for clarification......
