i bought a hyper 212 to find out it wont fit in my case , therefore is there any other good cooling solution which is similarly priced and is smaller ? i would say it was about 3cm out of the case

The Enermax cooler is out of stock at Newegg.
This Zalman is $20, with a $5 MIR (if you play that game and win): http://www.newegg.com/Product/Product.aspx?Item=N82E16835118128
Arctic has Intel and AMD versions of the Freezer 11 for $24 shipped.
The Hyper TX3 is $25, making CM a bang/buck Loser vs. its competitors, as usual.
...of course, if you are not buying in the US, your prices and availability will undoubtedly vary.

The Zalman cooler is loud and is poor performing (my friend had it).

Since I don't know your socket. Here is a Noctua low profile cooler. You will be fine with this unless you want to overclock.
Intel Version: http://www.amazon.com/Noctua-Low-Profile-Cooler-Retail-Cooling/dp/B009VCAJ7W

AMD Verison: http://www.newegg.com/Product/Product.aspx?Item=N82E16835608030&cm_re=noctua_CPU_cooler-_-35-608-030-_-Product

If you want one of the best low profile cooler, check this out (the fan can be moved to the bottom is still to big, but it is already very slim). http://www.newegg.com/Product/Product.aspx?Item=N82E16835608019&cm_re=noctua_CPU_cooler-_-35-608-019-_-Product

Here is an even smaller version http://www.newegg.com/Product/Product.aspx?Item=N82E16835608025&cm_re=noctua_CPU_cooler-_-35-608-025-_-Product
