For my pc build should I go with a i7 4770k and the ASUS Maximus vi formula or a i7 4790k with a z97 motherboard? and will I be loosing performance?

I don't think you'd lose any noticeable baseline performance, however, the Haswell Refresh processors are supposed to use a better thermal interface material inside of the CPU casing. That might mean the -4790K will give you better thermal performance, especially when overclocked.
If it were me, I'd be waiting for the Devil's Canyon chips or Broadwell if I were buying today.
