Should I RMA this GPU?

I recently purchased an MSI Geforce GTX 770 Twin Frozr OC Edition GPU and right after I got it, Origin put out Battlefield 3 for free, which was awesome. I looked up some benchmarks for my card and it looks like people were able to average 70 fps on ultra settings.

I'm getting 22.

Here's what I don't understand: When I change all the settings to low, I get exactly the same fps. I downloaded some software to measure CPU/GPU loads, and here's what I saw (ultra settings):

CPU - Intel i7 2600k @ 3.4 ghz (stock)
GPU - Geforce gtx 770 (stock)
Resolution: 1920x1080

Core 0: 75% Core 1: 50% Core 2: 50% Core 3: 50%
GPU: 35%

This is average. In heavy moments the cpu load would jump to 90% on a core and maybe 80% on another and the GPU would jump to 45-50%. When I take all the settings down to low, I see the exact same load numbers. So... is my CPU bottlenecking? Did I get a bad GPU? Also, why am I seeing the exact same framerate and hardware loads on ultra settings compared to the lowest settings? Any advice would be awesome. Thanks!

EDIT: If anyone is wondering, I installed the latest driver for the GPU.

What is your complete system spec, IE RAM, etc?
