Gigabyte ga-x79-up4 possible DOA?

I confirmed all my parts are working except for the new CPU and motherboard (CPU is intel core i7 4820k at stock clocks) and I already checked the CPU for any damage and reseated it but no luck so far.

i can get it to boot but not POST and i know the PSU and GPU are confirmed to be working as well as my RAM and since the CPU is not damaged it can only leave the motherboard as DOA but i want to make sure it is the mobo and not something else.

I did email gigabyte support RMA and through their official support system but I have had no reply for 3 working days.
