I have a Gateway DX4870-UB318 with a core i5 3rd gen 3330, can I put an i5 3570k instead? I can find any information on this, does anyone know or possibly point me in the right direction?

You should contact Gateway to be sure. Even if the motherboard chipset "officially" supports the processor it's very likely that Gateway will not have written BIOS support into the board. OEMs don't want you to upgrade they want you to buy a new system.

Even if the motherboard supports it, the 3570k is a waste. The board is locked and doesn't allow overclocking so spending extra on an unlocked CPU doesn't make sense. A 3570 would probably work but the performance gain from a 3330 isn't worth the cost of the upgrade.
