If i switch from my MSI 970A-G46 (AM3+) to a MSI Z97 gaming 7 with a 4770k will i have to buy a new oem windows 8 or can i use the same disk and licence key?

Solution
No. With Windows 8/8.1, Microsoft has loosened their OEM License Agreement to allow you to re-install the OS onto another computer/motherboard; but still, only onto one system at a time.

The main factor is how you obtained the OS.
Did you buy it and install it? If so, you can reuse as much as you want, one PC at a time
Was it preinstalled? If so, then it is indeed licensed to that original motherboard.

In either case, a clean install is needed.
