I have a toshiba laptop and the DVD is stuck inside but the tray is still working how do I get it out

Hang on a minute, if the tray still works what's your problem? Just open the tray and lift out the disc. I'm guessing there's something else you haven't told us yet or didn't explain very well?

Operate the disc tray in-out a few times. If that doesn't work you have to disassemble the laptop.
