New i7 4790K 4 Ghz strange problem

I just bought a i7 4790k 4 Ghz and paired it with a GA-Z97MX-gaming 5 motherboard. Sometimes when I boot, it acts very slow regardless of operating system, and it will continue to do this until i remove power from the system. And when I say remove power from the system a simple powerdown is not good enough, i have to physically remove the power cord and wait a good 30 seconds before plugging it back in.

I am running all stock settings and have tried upgrading the bios to the latest, but still the problem remains. I have the intel turbo boost monitor installed, and it looks like the cpu speed varys wildly when it is acting in a slow state. It will fluctuate from 4 ghz - as high as 6 ghz, but never crash. On a good boot, everything seems just fine, cpu temps, speeds etc work as expected. I'm guessing I got a bad board from gigabyte?
