If upgrading CPU, does it have to be New or can it be used?

It can be used, I've seen i7 2600k go pretty cheap. Nobody here likes to seem to talk about the great deals you can find used though. Shouldn't have a problem when buying from a good seller.
Idk why people would spend the money on a new i3 when you can get a sandy bridge or even ivy bridge locked i5 on ebay/amazon for a tiny bit more money.

Make sure you know the exact model number of the CPU you want to get so that it is compatible with your current motherboard. Not all I-5/i7's will necessarily fit in the same mb.

as long as it's the same socket and from a good seller I'd go for it, I've gotten some good deals on used stuff before

I bought my 2500k second-hand, but I got it from a shop rather than a person. Not only did I save quite a lot, I also got a year's warranty. Win-win.
