Gigabyte R9 290 Heat

Hello. I have the Gigabyte R9 290 windforce and sometimes it reached 94 degrees at 100% fan speed. So I took the computer out and put it on my bad and opened the case.
Than I ran Ungine heaven and it reached max 82 at 70%
The problem is that I think that it should not be 82 at 70% in open area with good ambient temp.
Maybe 82 with 40% fan speed. The card was bought used from a store with 2.3 years warranty.
It is wierd because I know someone with refrence sapphire r9 290 and his card never crossed 60 degrees.
Maybe it's my bios ? should I upgrade? and why does it say here:

That you can only update to a VBIOS version of the same series
And also can I update using other companies like Asus, sapphire bios even if i have gigabyte?

If its got the reference blower style cooler then them temps are totally normal.

All im asking is if 82 degrees with 72% fan speed on gigabyte r9 290 windforce is okay? im pretty sure not

Ah sorry, didnt see it was a windforce model.

Yeah thats a bit warm. Do you have good case airflow? What is your ambient temperature?

That's insane - I get like 72c tops with Sapphire Tri-X and the fans are hardly spinning.

Maybe your case airflow is really bad?

I think I found the problem when I go into OCCT it shows me only 2 fans and one of the two very slow

System specs:
I5 4590
8GB RAM
GA-HM1-HD3
R9 290 GIGABYTE WINDFORCE 1040/1250
2 case fans one 120 mm in front one 80 mm in rear
cpu cooler acrtic alpine 11 something like that..
im so frustrated and dispointed...
And also I'm pretty sure it's not problem in case airflow because I opened my case took my room fan put it on the highest level and it only reduced it by 3-4 degrees
I ran ungine heaven for 10 min and I got to 87 degrees with 90% fan speed

u can always return it if u find it heats too much

But what do I tell the store? I tried to tell them it gets really hot and it's not normal but they told me as long as the card doesnt pass 95 degrees which is the manufacter they can't use the warranty. is this true or they're just trying to kick me away?
