windows 8 upgrade for new build

I am planning to build a pretty decent gaming pc for around $600 and would like windows 8.1 for the OS. Physical copies are usually priced around $89.99 for windows 8 and up to around $120 for windows 8 pro. Microsoft lets you upgrade from windows 7 to windows 8 via download for as low as $69.99 and some 3rd party sites include a download and license. I was wondering if it is legal/possible to download the electronic copy of windows 8 from one of these sites but instead of installing it onto the laptop I would put it on a usb or disk and install it into my new build.

IMO, Windows 7 is much better if u have been using Windows for a while. Ive heard that it performs like 5FPS better in games, but i just hate the feel of Windows 8 "tiles" and all that stuff that 8 implemented. For example it took me 30 mins to work out how to shut down the computer (turns out that you have to go into settings . SETTINGS!!! sorry). Anyway, the only decent user interface i have seen recently is SteamOS (or steam big picture). Its the only one ive found that actually makes sense.
If you have been on windows for a while, I would suggest Windows 7, but if you are happy to re-learn or you are fairly new to windows go for windows 8(.1)
