GTX 55O TI when is too hot for this GPU ?

I am not an expert on GPU temperature but 98 degrees of celsius with open case is a lot for me at least and so my question is what do you guys think can I get my moneys back after 2 and half years when it is still in warranty or will they say that it's my fault ? Didn't touch it or everclocked it at all I only downclocked it because it had 80+ degrees before and was pretty loud.
 
It's probably just in need of a clean.
Take the card out and clean the fan with a cotton bud.
Then use a can of compressed air (it should be available in your local computer store/s) to blow out the heatsink. Blow it 'backwards' IN through the exhaust or TOWARDS the fan, depending on design. Be liberal with it and do it outside. ;)
Be careful not to hold the cooler assembly, just the edges of the card itself.
And yes, 98C is very hot, you were wise to downclock and keep the temperatures down.
BTW, while you're in there, check the CPU cooler, it's probably clogged as well, same rules apply: clean the fan with a cotton bud and use plenty of gas.
One point of caution, gently hold the fan to prevent it turning when you're blowing out the heatsink, they can be damaged by overspeeding and/or running in reverse.

Well I've RMA'd it and they said it's mechanical damage and they returned it repaired but now sometimes the screen flicks black for 1-2 sec, so I'm going to try new drivers, the temperature is 40 - 50 celsium without load so I will try few days how it is otherwise I will try RMA it once more.

The cooler was once in RMA because it had some very loud noise and well it was more or less not working well so they put new one there.
