While Comcast might have the technological ability to throttle bittorrent traffic, it doesnt. The technology itself is legal. Some companies like Blizzard Entertainment have used bittorrent as a mechanism for downloading and updating their games.
What you may be facing is a torrent that doesnt have much in the way of peers with the relevant data you are looking to download. When more peers have copies of the data on their systems, the more available it will be for upload and your download will speed up.
Comcast has a six strikes system in place, so if you get in trouble for downloading things that you shouldnt, you will get some sort of notice along with any possible action against your account.
