Choppy gameplay R9 280X Microstutter

R9 280x gigabyte drivers 13.9 same results with 14.1-14.7 beta
psu XFX 650 pro
ssd samsung evo 840
windows 7 SP1 64 bit
All at default clocks no overclocking done

Hi everyone i have choppy gameplay in many games i tried but i like to focus to dota 2
The game is running 60 fps steady with fraps
The frametimes are a bit messy i think take a look

I have tried msi afterburner and dxtory and radeon pro framelimit same results

I tested on windows 8.1 same results but when i tested on ubuntu microstutter was gone :??:
I have reformated multiple times no difference
With vsync on there is visible microstutter with vsync off the game feels choppy
The same thing happens on starcraft 2 divinity original sin total war shogun 2 and others
Anyone has an idea what is the problem??

Dota 2 has auto update feature so no need to patch. Its not only dota 2 that has this problem im runnning windows 7 so no need for compatibility mode too
