Gigabyte GA-Z97X-UD5H Bios Temps off Between UEFI & Classic Bios

My temps from dead cold boot in UEFI Bios is 37c (27c open case temp).

After booting up and 15 minutes idle, with fresh installed Win8, temp of 4790k is 41-42c (31c case temp).

I get another 5c increase from above if you see temps by switching from UEFI to the traditional classic MIT Bios.

Not even the mobo's tech Support had a "believable" explanation as to why my temps are different between both BIOSes....This is the 2nd Gigabyte mobo that shows this discrepancy (firmware is up to date, btw).

My mobo is a Gigabyte GA-Z97X-UD5H, with Arctic Silver 5 mounted to Noctua D14 heat sink.

Temps are recorded with case open and with an additional 3 120mm Noctua fans mounted in the back on my Antec mid-tower case.

...Forgive my noobness.....HOW can a dead COLD boot be 37C??! Temps are too high, correct?....And then I get an additional increase of 4-5c in UEFI temps after 15 minutes. Is the Noctua heat sink doing it's job?

What are my options?..........Should I RMA the CPU? RMA the mobo? Reapply AS5 with the heat sink?...

I have no idea what to do at this point and seek your experience/wisdom....

I always heared that the temps are higher in the BIOS because of its power in it, compared to your OS. Your room tempurature can determine your cold boot temps as well. Sometimes mine starts at 29 degrees and sometimes is 32-34 degrees. I would not worry about it unless there are obvious issues. Gigabyte boards seem to run hot according to some other threads on here as well. When did you apply your thermal paste? It could be dry or old.

Understood.

I applied the AS5 7 days ago and albeit there is a "curing" time where AS5 performs better, that's only a 1-2c drop.

I bought some top performing Gelid Extreme paste but I'm worried the board is messed up or the thermal paste under the lid of the CPU is bad and should RMA it before my 30 days are up...
