im about to buy a rig. which would you think is better buy a 2-3 yr old 2500k or buy a new 4440? i know the 2500k would be better but it is 2-3 yr old chip and might have lost some of its performance? what do you guys think?

SB overclocks much better and its cooler than the new haswell, if you are interested on overclocking you should take this in consideration, but you can get a 4690K. Tho if i were you i would get the newer gen, or wait for broadwell :)
If you are not interested in overclicking, Have you thought about 4570/4690?

Well the i5 4440 is faster and uses less power at stock speeds. Overcloked the 2500k is a bit better but its not worth getting an old cpu to overclock is it used too? I would just get the 4440. Or you could save up and get a 3570k or 4690k they are like 20-50 dollars more than the 4440.

There is no inherent reason a CPU "loses some of it's performance", just because it ages. It either works or it doesn't. Of course, this assume it has not been abused to the point where thermal interfaces have degraded and the CPU throttles back due to heat issues.
