I was just wondering on how they could tell. Lets say i get a 4770k and i only can OC it to 4.3 whilst other people can get it to 4.5. If i got the shit end of the stick and wanted to keep returning them until i got one to 4.5. How would they know if it was tinkered with?

While I wouldn't recommend doing what you're planning on doing, the majority of people and manufactures have stated that its not possible unless you burn it out and/or there is noticeable damage. All you do is reset clock and send it back, unless it breaks after overclocking(obviously)
