I don't know what the temps and airflow are like inside of and around your case, but having the same reference model 290x it hardly ever elevates over 82c when in the most demanding games I set the fan to 85% overclocked at 1150 mhz and 1600 mhz, +100 in core voltage and +50 in power limit with Afterburner. If it already isn't, make sure that switch on the GPU is set in the position *away* from the video output ports on the card as there's both an uber and silent mode, with the silent mode throttling the card at a lower preset of combined factors than in uber mode. Also, even in uber mode I used to get variable downclocks when overclocked (Powertune) which used to piss me off, by first overclocking in Afterburner and then opening CCC to additionally set the power limit to +50 to then minimize it to background processes, I'm able to maintain consistent clock speeds without having to worry about variables or downclocking.
I think 95 c is the max operating temp before throttling for this card so if you're at 94 c "no matter what," then yeah, throttling is probably the issue that will have to be resolved with implementing some type of water cooling, whether CPU or GPU (likely more efficient solution), into your PC. Other than that, could just be a bad card.

but amd says it is ment to be at 95 C all the time so that the fan doesn't have to get too loud etc. but i don't understand how you are able to put up with you're fan at 85%. that. is. insanly. loud. i cannot put it higher than 45 without waking my neighbours up. i don't that difference in our cards, i will try the uber mode switch now and upload the pics.

It may have no problem with 1070 MHz with a game in the background, but alt-tab back into the game and it may throttle again.
95°C may be AMD's quoted maximum for the card, but that just means its components are rated for operation at that temperature. Its definitely throttling at that temp, and so much heat inside your case could be raising the temperature of the rest of your hardware as well. I would be aiming for no more than about 85 at the high end, if it were me.
I don't really have a fix for you, because this is a known issue since launch and the 290X probably shouldn't be sold with a reference cooler in the first place. I'd probably try replacing the thermal compound and trying to maximize the airflow inside the case the best you can.
