it idles at 40c and under load 70c using hyper evo 212 not overclocked i feel its running to hot is there anything i can do?

If you are using the stock thermal paste that came with the cooler then you might want to replace it with something better. You can find good thermal paste on newegg for $10. If you want even better cooling you can try a better air cooler or step it up to a cheap closed loop water cooling set.

I don't have the stock thermal paste on there i have artic silver 5 thermal paste i bought that about a week and installed it.

Okay then it would be time to upgrade your cooler or change the ambient room temperature. The outside room temp. matters quite a bit. If your room is 80 degrees Fahrenheit then your cooler will be using that 80 degree air to cool an already hot cpu. But if your room temp is 70 degrees then your cooler will use 70 degree air to cool you cpu, making it much more effective. I used to have this problem and I found that opening a door or a window can lower my case temp. by 1-5 degrees Celsius!

Which cpu cooler do you recommend? I would like the most effective one.

I would recommend a closed loop water cooler, as they tend to be quite and more efficient. The problem with them though is the fact that you have to have a nearby 120mm fan mount near your cpu. A good cheap cooler id the corsair h60. It has nothing special and wont cool a largely overclocked build, but it performs better then most air coolers.

With a h100i watercooler the i7-4790K at 4.4Ghz 100% load in Aida64, Prime95 and IntelBurn you should get no more heat than 63 to 65 Degrees max. At idle depending on outside temps you should get around 25 to 27 Degrees.

The H100i is a good AIO unit but there are better units out there i.e bigger rad's etc.

The H100i is a great unit, but he said that their was no overclocking, so a single 140mm rad should do it, and if he gets a nice one it would allow for a little overclocking if he wanted to, it also would not be as expensive.
