Is my CPU Throttling?

Hi,

This has been an ongoing problem for a while but has been getting worse recently I believe.
I think it's a problem with the CPU but let me know what you think.

The problems:
The PC will drastically slow and lag periodically when doing extensive tasks. The main example being when I want to stream a game, such as dota, with OBS. The socket temp gets very high (highs at 76) and the core temps have a thermal margin of around 10-20 degrees. As temps rise, the cpu will periodically downclock itself to 1400mhz and usage will rocket to 100% for a short amount of time. This causes everything to slow and fps to drop drastically. Then within a few seconds, cpu clock speed rises again (3700MHz) and everything returns to normal.
This also happens when I just have a twitch stream on my second monitor and I'm in game on my main monitor. The attached screenshots show this happening.

I believe it's due to the fact that my cpu is getting too hot and then it's being throttled automatically causing everything to lock up.

Today I installed a Hyper 212 Evo to try and stop temps getting too high but sadly it didn't make much of a difference other than 5-7 degrees cooler.

This image is with the stock cooler and as you can see in game fps drops and cpu frequency drops but usage rises.
This image is with the hyper 212 and while it's a bit cooler, the same thing happens.

On a side note, twitch always seems to cause large rises in cpu usage and temps.

Any ideas would be appreciated, thanks.

My specs are:
Fx 8320 (stock clock) + hyper 212 evo
Asrock 970 Extreme 4
Corsair Vengeance 8gb
EVGA Gtx 760
Corsair CX500M
The PC is 1 year old and has slowly but surely been slowing down

Do you think maybe it's worth RMAing it as no matter what I do, it always runs hot and the problems keep on coming. You'd think I shouldn't have to undervolt a stock clock cpu unless it was faulty in some way

I was hoping no one would say this. Maybe I should wait for a couple of days before doing that to see if the paste will settle and temps drop. I have a front and top intake, a rear exhaust and a fan on the side of my case so I'm not sure if that's the issue
