Can i get a replacement for my 280x ?

I have Asus 280x Top GPU which is 9 month old and now i see artifacts like sometime...i want to replace it with gtx770...If i approach service center for this..Will i get a gtx 770 as replacement ...I live in india and this card is a second hand one and with all original bill and accessories ...help

But i heard people getting 770 in replacement of 280x or getting refund or an upper version of card with some little extra...So Does that apply till the 3yr warranty period or what ?

Ok don't get hyper...i just asked if anybody have such experience like me..he/she might be knowing
